By accessing or using Viralcast ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Viralcast is an AI-powered social media content creation and scheduling platform. The Service allows you to connect your social media accounts (including Instagram, TikTok, and Facebook), generate original content using artificial intelligence, and schedule that content for automated publishing.

The Service includes but is not limited to: AI content generation, multi-platform post scheduling, analytics dashboards, and account management tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at team@amplifai-yp9.madethis.app of any unauthorized use of your account.

You agree to provide accurate, current, and complete information when creating your account and to update such information to keep it accurate. You may not share your account credentials with any third party.

You are solely responsible for all content you create, schedule, or publish through the Service, including content generated with AI assistance that you choose to post. You retain full control over what is published from your connected accounts.

You agree not to use the Service to:

• Violate any applicable law or regulation, or the terms of service of any connected social media platform
• Post spam, misleading content, hate speech, harassment, or content that is defamatory, obscene, or otherwise objectionable
• Infringe any intellectual property right, privacy right, or other right of any person or entity
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Use the Service to generate or distribute disinformation, deepfakes, or other deceptive content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell or sublicense access to the Service without our prior written consent

The Service, including its software, design, trademarks, and underlying technology, is owned by Viralcast and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand elements without our prior written consent.

You retain ownership of any content you provide to the Service. By using the Service, you grant Viralcast a limited, non-exclusive, royalty-free license to use, process, and transmit your content solely to provide and improve the Service.

AI-generated content produced through the Service is provided to you for your own use. You are responsible for ensuring that content you publish complies with applicable laws and does not infringe any third-party rights.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Viralcast does not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose. Social media platform availability and API access may change without notice and are outside our control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRALCAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will immediately cease.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

Upon termination, we may delete your account data in accordance with our data retention practices described in our Privacy Policy.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, for material changes, provide notice through the Service or via email.
